Complex civil litigation may involve difficult or novel legal issues; issues that are likely to take considerable time to resolve; multiple parties, multiple courts or jurisdictions; extensive discovery and voluminous documents; numerous witnesses, experts, attorneys or exhibits; substantial time to complete a trial, substantial post-judgment judicial supervision, and other complicating factors. Complex civil litigation can be drawn-out, convoluted, and costly.
At the Law Offices of Jennifer S. Carroll, P.A., we study each case thoroughly to identify all the relevant legal issues involved, and always seek the most favorable outcome for our clients using the most direct path possible. Some cases can be resolved before trial or during trial – purely as a matter of law. This can occur by way of a dismissal, summary judgment, judgment on the pleadings, directed verdict, and various other legal resolutions. The legal grounds raised at the trial level can be a basis for reversal or affirmance on appeal. That is why it is important to have an attorney experienced in complex civil litigation and appellate law in state and federal courts.
At the Law Offices of Jennifer S. Carroll, P.A., we have the determination, the experience, and the passion to deliver effective representation for you in broad areas of complex civil litigation, including: business litigation, including corporate and shareholder litigation, probate and estate litigation, commercial law, rights, anti-trust issues, class action laws, and unfair trade practices. and consumer protection.
In 2009, the Florida Supreme Court established new Rules of Procedure for Complex Litigation, in an effort to manage complex cases that needed special attention. Complex civil litigation may have complicated legal or case management issues, require management by the court to keep the case moving forward, keep the costs down, and make the most efficient use of the court system. That led to the establishment of divisions dedicated to these types of cases in courts throughout Florida.
These rules are set forth in the Florida Rules of Civil Procedure 1.201.
